Raised in Miami, Florida, Jeffrey E. Marcus earned his B.A. from Yale University, where he was an early selection member of Phi Beta Kappa and graduated magna cum laude, and his J.D. from Yale Law School, where he was a finalist in the Harlan Fiske Stone Moot Court Competition. Following law school, Mr. Marcus clerked for the Honorable Stanley Marcus of the United States Court of Appeals for the Eleventh Circuit in 1999 and for the Honorable Donald M. Middlebrooks of the United States District Court for the Southern District of Florida in 2000.
Prior to joining Kenny Nachwalter, Mr. Marcus served as an Assistant United States Attorney for the Southern District of Florida. As an AUSA, Mr. Marcus tried more than 20 cases to jury verdict, argued several appeals before the Eleventh Circuit, and conducted numerous grand jury investigations. Mr. Marcus was a member of the Economic Crimes Section and specialized in healthcare and pharmaceutical fraud and abuse cases. He successfully prosecuted numerous corporate owners and officers as well as medical professionals in matters including billing fraud schemes to defraud hospitals by suppliers of medical and pharmaceutical products, billing fraud schemes to defraud the Medicare program by medical providers and clinics and medical supply and billing companies, improper sales and marketing activities under the federal Anti-Kickback Act, improper pharmaceutical sales by internet pharmacies, and the distribution of medical products and devices in violation of the FDA Act. Mr. Marcus also has experience with parallel criminal and civil False Claims Act investigations, including those involving qui tam (whistleblower) allegations. For his healthcare fraud work, Mr. Marcus received awards and commendations from HHS-OIG, FBI, and U.S. Secret Service.
Prior to joining the USAO, Mr. Marcus was in private practice in Boston, Massachusetts where he specialized in white-collar criminal defense and complex civil litigation. During that time, Mr. Marcus successfully represented a sales and marketing manager of a leading pharmaceutical manufacturer in a four-month trial in which she was acquitted of all charges of providing physicians and hospitals with unlawful kickbacks.
Mr. Marcus’ practice focuses on white-collar criminal defense, corporate investigations, health care law and compliance, and complex civil litigation.
Mr. Marcus is a member of the State Bars of Florida and Massachusetts, the American and Federal Bar Associations, and the National and Florida Associations of Criminal Defense Lawyers. Mr. Marcus has been admitted to practice in the Eleventh Circuit Court of Appeals, the United States District Courts for the Southern and Middle Districts of Florida and the District of Massachusetts. Mr. Marcus also is an adjunct Instructor at the University of Miami Law School.
